(All classes will be conducted in person) Session 1: Orientation - Technology Management and Intellectual Property This session provides an overview of technology management practices in Japanese manufacturers, which have pursued product differentiation through technological development since the period of high economic growth. It examines the role of intellectual property within technology management and explores the significance of intellectual property education for personnel involved in research and development. Session 2: Patent System (Examination Process) For companies advocating technology management, intellectual property strategy centers on acquiring and utilizing patents, premised on the patent system. Therefore, students will learn the characteristics of the patent system, the significance of obtaining patents, and the fundamentals of patent strategy, serving as the first step in learning intellectual property strategy. Session 3: Patent System (Case Study) To acquire the practical knowledge essential for future research and development work, students engage in patent practice exercises. Specifically, using a case where a rejection reason denying “inventive step” was notified for a filed invention, they examine the conditions for obtaining a patent right and methods for constructing arguments. Session 4: Patent Licensing To gain a comprehensive understanding of the significance of patent acquisition for companies, examine specific examples and their significance, such as exclusive in-house implementation, open-close strategies, standardization strategies, and industry-academia collaboration. Session 5: Patent Licensing (Case Study) To understand the significance of patent acquisition and licensing agreements for companies, examine the reality of licensing to competitors through specific cases and consider the significance of technology licensing/introduction in technology management. Session 6: Patent Infringement Understand the background of patent infringement in technology management and the institutional framework for addressing it. Session 7: Patent Infringement (Case Study) Examine countermeasures when patent infringement occurs (injunction requests, damage claims, reputation restoration requests) and their business impact through specific cases. Session 8: Copyright System As an overview of the Copyright Act, grasp its fundamental principles and structure, including “Purpose of the Copyright Act,” “Authors and Copyright Holders,” “Copyright,” “Neighboring Rights,” “Term of Protection,” and “Limitations on Rights,” and examine the intersection between technology management and copyright. Session 9: Copyright and AI (Case Study) AI, which has rapidly developed and proliferated in recent years, is intrinsically linked to copyright in its fundamental nature. We examine the realities of litigation and current administrative responses across countries and regions, along with key considerations for AI utilization. Session 10: Design System Design in consumer products is a source of profit and is pursued alongside quality and service in product development. We will grasp the fundamentals of the design system for legally protecting product designs and examine the significance of design strategy in corporate management. Session 11: Trademark System Brands are a source of customer attraction. They require continuous management in corporate operations, such as promoting cultivated technological capabilities as a brand. We will grasp the fundamentals of the trademark system for legally protecting brands and deepen our understanding of the effects and value of brands in corporate management. Session 12: Trademark Strategy (Case Study) Using a brand name or logo without acquiring trademark rights carries the risk of infringing on another company's trademark rights. We will examine countermeasures when a trademark intended for use falls within the scope of another company's existing trademark rights through a specific case study. Session 13: Trade Secret Management (Unfair Competition) Learn about systems to prevent unfair competition acts, such as leaks to competing companies, concerning technologies (trade secrets) that are kept confidential without obtaining patents or other intellectual property rights. Recognizing that individuals can be in the position of either developer or user, understand the types and content of unfair competition acts through specific cases. Session 14: Other Intellectual Property Systems Gain an overview of other intellectual property systems not yet covered, including intellectual property-related treaties, intellectual property protected under civil law, interests protected under unfair competition law (other than trade secrets), systems protecting new plant varieties (Seed and Plant Variety Protection Act/Breeder's Rights), and protection for minor inventions (Utility Model Act). This provides a comprehensive view of intellectual property management. Session 15: Intellectual Property and Technology Management Synthesize knowledge acquired thus far to examine corporate intellectual property strategies in specific situations through concrete case studies. Work experience of the instructor
